2. Acceptance of Terms
By accessing this Website or engaging Sayang Legal for any Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you should not use this Website or engage our services.
To engage our services, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law. If you are acting on behalf of another person or an organisation, you represent that you have authority to do so.
We may update these Terms from time to time. Continued use of the Website or services after an update constitutes acceptance of the revised terms.
3. Service Description
Sayang Legal provides family law services in Malaysia. Our current service offerings are as follows:
- Initial Family Counsel Session (RM 500): A private, one-hour consultation to help clients understand their situation and the legal scope relevant to it, concluded with a short written summary note. No obligation to proceed further arises from this session.
- Drafting of Settlement Letter (RM 700): Preparation of a considered letter on the client's behalf, reviewed and revised with the client before dispatch, intended to open measured dialogue with the other party.
- Custody Variation Application (RM 1,500): Preparation of a formal application to vary an existing custody arrangement where circumstances have materially changed, conducted with care for the children's stability and a realistic assessment of outcomes.
Services are available to clients located in or connected to Malaysia. We will confirm at the point of engagement whether a particular matter falls within our scope of practice.
4. Client Accounts and Engagement
This Website does not operate client accounts or require registration. Engagement with Sayang Legal is initiated through the contact form on this Website or by direct communication. Upon receipt of an enquiry, we will confirm the scope of the proposed engagement in writing before work begins.
Clients are responsible for providing accurate and complete information to allow us to assist effectively. Providing misleading or incomplete information may affect the quality of advice and service we are able to offer.
5. User Responsibilities
You agree to use this Website and our services only for lawful purposes and in a manner consistent with these Terms. In particular, you agree not to:
- Use the Website in any way that violates applicable Malaysian law or regulation;
- Submit false, misleading, or fraudulent information through any contact form or communication channel;
- Attempt to gain unauthorised access to any part of the Website or any system connected to it;
- Copy, reproduce, distribute, or commercially exploit any Content on the Website without our written consent;
- Use automated tools to scrape or collect data from this Website;
- Engage in conduct that is harassing, abusive, or otherwise harmful toward our staff.
We reserve the right to decline or discontinue a service engagement if conduct is inconsistent with these responsibilities.
6. Intellectual Property
All Content on this Website — including text, layout, and design — is owned by or licensed to Sayang Legal and is protected under Malaysian intellectual property law. You may view and print Content for your own personal reference only.
Documents and written notes prepared for you as part of a Service are provided for your personal use in connection with the matter engaged. They are not to be reproduced, redistributed, or used for purposes other than those for which they were prepared without prior written agreement.
You retain ownership of any personal information or documents you provide to us. By providing these, you grant us a limited licence to use them solely for the purpose of delivering the agreed Service.
7. Payment Terms
Fees are stated in Malaysian Ringgit (RM) and are payable as set out in the engagement confirmation. Payment is typically required prior to or at the commencement of the relevant service.
Payment methods accepted will be confirmed at the point of engagement. We do not store payment card details on this Website.
7.1 Refunds
Once a service has been delivered — including a counsel session held, a letter drafted, or an application prepared — fees are not refundable, except where required by Malaysian consumer protection law. If for any reason we are unable to deliver the agreed service, a proportionate refund will be offered at our discretion.
Any concerns about service delivery should be raised with us directly at [email protected].
8. Service-Specific Terms
8.1 Counsel Session
The Initial Family Counsel Session is a structured conversation, not a formal legal opinion. The written summary note provided is a record of the session and does not constitute legal advice for the purposes of court proceedings.
8.2 Settlement Letter
The letter will be sent only on the client's explicit written instruction. Sayang Legal takes no responsibility for the response of the recipient party or the outcome of any negotiation that follows.
8.3 Custody Variation Application
Preparation of an application does not guarantee a particular outcome in court proceedings. We will provide a realistic assessment of prospects and will advise if we believe the application is unlikely to succeed on the available facts.
9. Disclaimers
The information on this Website is provided for general informational purposes. It does not constitute legal advice and should not be relied upon as a substitute for professional legal counsel specific to your circumstances.
While we take care to keep information current, we do not warrant that Website content is accurate, complete, or up to date at all times. We provide services with reasonable professional care and skill, but we do not warrant or represent that any particular outcome will result from the engagement.
10. Limitation of Liability
To the extent permitted by Malaysian law, Sayang Legal's total liability to you in connection with any service shall not exceed the fees paid by you for that specific service.
We shall not be liable for indirect, consequential, or special loss arising from the use of this Website or our services, including but not limited to loss of opportunity, loss of reputation, or third-party claims.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11. Confidentiality
We treat all information shared with us in the course of a service engagement as confidential. We will not disclose personal or case information to third parties except where required by law, with your consent, or where necessary to deliver the agreed service (for example, communication with a court or opposing counsel on your instructions).
Our obligations regarding personal data are further described in our Privacy Policy.
12. Indemnification
You agree to indemnify and hold harmless Sayang Legal, its solicitors, and staff from any claims, losses, or expenses (including legal costs) arising from your breach of these Terms, your use of this Website in violation of applicable law, or any misrepresentation made by you in the course of engaging our services.
13. Termination
Either party may withdraw from a service engagement at any time by written notice. If you withdraw after work has commenced, fees may be payable on a pro-rata basis for work completed. If we withdraw, we will provide reasonable notice and, where possible, guidance on alternative options.
Sections covering intellectual property, confidentiality, limitation of liability, and dispute resolution continue to apply after termination of any engagement.
14. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms or any service engagement shall be subject to the jurisdiction of the Malaysian courts.
We encourage you to raise any concern with us directly in the first instance at [email protected]. We will make a genuine effort to resolve concerns informally before either party seeks formal recourse.
Where informal resolution is not achieved, either party may refer the matter to mediation under the rules of the Malaysian Mediation Centre before commencing court proceedings, without prejudice to either party's right to seek interim relief.
15. General Provisions
15.1 Entire Agreement
These Terms, together with any engagement letter issued, constitute the entire agreement between you and Sayang Legal in respect of the Website and the services described herein, and supersede any prior communications on those matters.
15.2 Severability
If any provision of these Terms is found by a court to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
15.3 No Waiver
A failure by Sayang Legal to exercise or enforce any right under these Terms shall not constitute a waiver of that right.
15.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations in connection with a reorganisation of our practice, provided such transfer does not prejudice your position.
16. Changes to These Terms
We may revise these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. If changes are material to an ongoing engagement, we will inform you directly. Continued use of the Website after the effective date of any revision constitutes your acceptance of the updated Terms.
